Judge Masipa has disclosed that judgment of Oscar Pistorius
will continue tomorrow September 12. Although no official verdict has been
given, but Judge Masipa just said that Pistorius failed the reasonable man
test. "Pistorius knew there was a person behind the door, he chose
to use a firearm. I am not persuaded that a reasonable person with the same
disability in the same circumstances would've fired four shots into that small
toilet cubicle.
"There was no explanation why the accused didn’t call
security before arming himself and going to the bathroom."
Legal analyst Kelly Phelps says that once Pistorius fails
the reasonable man test, there's no other outcome for the trial BUT culpable
homicide.
Failing the reasonable man test could mean Pistorius is
guilty of culpable homicide or manslaughter as it's known in the U.S. and UK.
The maximum sentence for culpable homicide is 15 years but there is not mandatory minimum.
